SC dismisses Swamy's petition
NEW DELHI, APRIL 16. The Supreme Court today dismissed a petition
filed by the Janata Dal president, Dr. Subramanian Swamy, seeking
dismissal of a Rs. 50 lakh suit by the former Law Minister, Mr.
Ram Jethmalani, against him in Delhi High Court. A bench
comprising Mr. Justice S. Rajendra Babu and Mr. Justice K. G.
Balakrishnan said it was not inclined to interfere in the
hearings of the suit at this stage and dismissed the petition.
Mr. Jethmalani had filed the suit seeking Rs. 50 lakhs as damages
from Dr. Swamy, accusing him of making certain statements during
the Jain Commission hearing in 1993, linking him to LTTE which
tarnished his image and caused loss to his reputation.
The High Court had framed issues but Dr. Swamy made an
application seeking rejection of Mr. Jethmalani's suit on the
ground that it did not disclose any cause of action and that the
suit was barred by Sec. 6 of the Commission of Inquiry Act.
