A three-Judge Bench, comprising Justice B.N. Kirpal Justice Arijit Pasayat and Justice H.K. Sema, recorded a statement in this regard from the Solicitor General and counsel for the State, Harish Salve, and gave a direction to this effect.
Mr. Salve, also informed the Bench that students in relief camps in Ahmedabad and other parts of the State would be allowed to re-appear for the supplementary examinations even if they had taken the tests in March/April, after giving an undertaking that their previous examinations should be considered cancelled.
The Bench, while recording the submissions of Mr. Salve put in an affidavit, gave directions on those lines.
Counsel for the petitioner, Lok Adhikar Sangh, which had appealed against a Gujarat High Court order refusing to allow re-examination for classes X and XII, suggested that the centres for the fresh tests should be chosen carefully so that students from the minority areas were not put in discomfort.
The Bench, however, said the Government could decide and identify adequate number of centres for holding the supplementary examinations.
The Bench made it clear that holding the supplementary examination would not in any way affect the right of the State Education Board to declare the results of those students who had taken the April tests, keeping in mind the interest of the large number of students appearing for various competitive examinations.
The petitioner's counsel said that it was possible that people were spreading rumours.
``We are not going to give credence to rumours. Obviously, some people from both sides have an agenda'', the Bench observed.
``We are not satisfied that the adults in Gujarat behaved responsibly'' during and after the riots, the Bench added.
