Fruit traders told to shift to new APMC yard

BANGALORE SEPT 12. The Karnataka High Court on Friday directed the fruit traders in the bazaar area near Binny Mills in the city to shift to the new sub-market yard of the Special Agricultural Produce Marketing Committee (APMC) for Fruits and Vegetables before October 15. It directed the APMC to finish allotment of shops at the new yard before September 30.

Justice N.K. Patil passed the order while disposing of a bunch of petitions filed by the Bangalore Fruits Commission Agents' Association and 258 individual traders challenging the Government order issued on July 17 directing the traders to shift to the new sub-market yard from the Bazaar area yard.

Mr. Justice Patil directed the APMC to allot shops-cum-godowns to "eligible petitioners" who had applied for the same. He further directed the APMC not to force the petitioners to shift to the new premises till October 15, and asked it to consider the applications filed by petitioners for licence. The petitioners contended that the Government had constructed a new market yard on 20 acres of land at Singasandra village, Sarjapur Hobli, Anekal Taluk. Fruit traders were asked to shift to the new premises on July 24. Though there were 260 fruit merchants in the Bazaar area, the APMC allotted shops to only 167 of them. They would not shift to the new premises unless all of them were allotted shops. Moreover, the new yard lacked basic amenities, they said. The APMC, however, said it had laid concrete roads and a drainage system, and had made arrangements for a post office, a police station, and other amenities at the new yard.

Petition dismissed

The Chief Justice of the Karnataka High Court, N.K. Jain, and Justice H. Billappa, constituting a Division Bench, today dismissed a public interest writ petition filed by Hottepaksha Rangaswamy of Bangalore. The petitioner urged the court to direct the Chief Minister to take steps to waive loans amounting to Rs. 300 crore taken by farmers.

Notice to Mayor

The same Bench ordered issue of notice to the Mayor and the Commissioner of the Bangalore Mahanagara Palike (BMP) on a public interest writ petition filed by Bhaktavatsala, president of the All-India Advocates' Association, Bangalore. The petitioner urged the court to direct the respondent to hand over possession of a proposed building adjacent to the Mayo Hall Court premises for conducting court proceedings.

The petitioner said the Mayor had reportedly stated that the BMP proposed to set up a museum in memory of Kempe Gowda, founder of Bangalore, near the Mayo Hall. The proposed building could be used for court proceedings for the benefit of the people. The judges adjourned further hearing of the petition.

Notice to TMC

Justice N.K. Patil today ordered issue of notice to the Hoskote Town Municipal Council (TMC) and directed the public prosecutors to take notice of it on behalf of the State on a writ petition filed by the Madhuri Charitable Trust, Hoskote, Bangalore Rural district, and nine others. The petitioners urged the court to direct the Excise authorities not to open an office on the premises adjacent to a school run by the trust.
