A Bench, comprising the Chief Justice, Justice V.N. Khare, and Justice S.B. Sinha, made it clear to the States, observing ``either do it or face the consequence of returning the Central grant to the Government of India". The Bench asked Andhra Pradesh, Bihar, Goa, Gujarat, Haryana, Himachal Pradesh, Karnataka, Kerala, Madhya Pradesh, Maharashtra, Orissa and West Bengal and the respective High Courts to make the required number of FTCs functional. Pointing out that while the States were blaming the High Courts for not appointing the judicial officers and the High Courts blaming the State Governments for not creating infrastructure, the Bench said ``it is rather sad state of affairs where the State Governments are blaming the High Courts and the High Courts are blaming the States.''
