'PM will decide on demand'

Onboard Special IAF Aircraft Sept. 23. The Deputy Prime Minister, L. K. Advani, said today that the Prime Minister, Atal Bihari Vajpayee, would decide on the demand for the Union Minister, M. Kannappan's removal, following the Tamil Nadu Government's threat to arrest him under the Prevention of Terrorism Act (POTA).

Speaking to reporters on way to Jagdalpur in Bastar district, he asserted that the implementation of the Act lay with the State Government even though the Act was enacted by the Centre. Mr. Advani said mere allegations could not be levelled against any State Government about misuse of the POTA and if cases were before the courts, they would decide.

The Tamil Nadu Chief Minister, Jayalalithaa, had in a letter to Mr. Vajpayee yesterday, demanded that the MDMK leader, M. Kannappan, be removed from the Union Cabinet.

"It is up to the Prime Minister to comment on Ms. Jayalalithaa's letter," Mr Advani said.

"While all — Cr.P.C., IPC and POTA — are enacted by the Centre, their implementation lay only with a State Government." Asked about another MDMK leader, Vaiko, who has been in jail for almost a year now under POTA, Mr. Advani said the Centre had filed two affidavits before the court stating that the case did not attract the provisions of POTA.
