Court ruling on retail wine shops

HYDERABAD SEPT. 25. L. Narasimha Reddy, judge of the A.P. High Court, on Thursday declared that officers of the Excise Department cannot initiate proceedings against retail wine shops in the name of not adhering to recommended maximum retail price (RMRP) while selling the bottles of IFML.

The judge was disposing of writ petitions filed by M. Satyanarayana Goud on behalf of Redlips Wines, Ibrahimpatnam, Krishna district, and other dealers. The petitioners informed the court that the RMRP is meant for consumer awareness only and the rules framed by the Excise Act and the provisions of the Act do not provide for adherence of RMRP. They said the licence fee to Municipal Corporation is Rs. 12 lakhs per annum and fee for a shop in a rural area adjacent to the same corporation is Rs. 3 lakhs per annum. Due to these variations dealers are forced to sell liquor either at higher rates of RMRP or for lower rates.
