Dara Singh moves HC

BHUBANESWAR OCT. 10. Nearly three weeks after he was awarded the death penalty in the Graham Staines case, Dara Singh today moved the Orissa High Court challenging the order of the CBI Judge, Mahendra Nath Patnaik.The petition was likely to come up for hearing on Monday, Brahmananda Panda, Dara Singh's counsel, told The Hindu. However, no petition has been filed on behalf of the 12 others who were awarded life term in the case.

According to Mr. Panda, it has been submitted in the petition that the trial court judge had disbelieved the First Information Report (FIR) that was initially lodged with the local police. It has been further submitted that Dara Singh was innocent and the Central Bureau of Investigation (CBI), which subsequently took over the investigation, had falsely implicated him.

A separate application has also been filed along with the main petition praying that Dara Singh be allowed to go to his village in Uttar Pradesh to take part in the last rites of his father who died on October 1. Soon after the CBI court pronounced its verdict on September 22, Dara Singh's counsel, Bana Mohanty, told presspersons that his client had decided not to challenge the order.
