Vikas Yadav's bail plea dismissed

NEW DELHI OCT. 14. The Delhi High Court today dismissed applications seeking interim bail by Vikas Yadav and his cousin, Vishal Yadav, in the Nitish Katara murder case, observing that their plea could not be taken for consideration unless Vikas's sister, Bharti Yadav's statement was recorded by the trial court.

Vikas and Vishal, son and nephew of the Rajya Sabha MP, D.P. Yadav, are facing prosecution in the case for allegedly kidnapping and later killing Nitish Katara, son of a senior Indian Administrative Service (IAS) officer here, in February 2002.

Nitish Katara, batchmate of Bharti in the Indian Management Institute (IMT), Ghaziabad, was allegedly kidnapped by the two accused from the wedding ceremony of one of Bharti's friends in Kavi Nagar in that town. A few days later, Nitish's body was found on roadside in Bulandshahar in Uttar Pradesh.

Dismissing the two applications, Justice R.C. Chopra, said the petitioners were at liberty to move the lower court for bail after examination of Bharti by the trial court.

Bharti, who is at present doing some professional course in London, is a key prosecution witness in the case. Neelam Katara, mother of Nitish, has also great faith in Bharti so far as the circumstances and factors leading to the murder of her son were concerned.

While recording her statement in the case in the lower court earlier this year, Neelam had said that Bharti knew all the facts of the case and that she believed that the accused's sister would tell the truth to the court.
