The petition was admitted by the Bench comprising Justice S. Sankarasubban and Justice K.K. Dinesan. The petition was filed by the Guruvayur Devaswom Employees' Association. The court had issued the directive while setting aside Government Orders reducing the extent of land to be acquired from 25 metre to 10 metre radius.
Saswathikananda's
death case
Justice K. Padmanabhan Nair today directed the Public Prosecutor to inform the court whether the investigation into the death of Swami Saswathikananda, former Sivagiri Madhom chief, could be entrusted with a police officer. The Judge sought the opinion of the public prosecutor when a petition seeking a CBI probe into the death came up before the court.
Court refuses to expunge remarks
Justice K. Padmanabhan Nair today dismissed a petition filed by S.P. Gopalakrihnan, Dy.S.P., seeking to expunge certain adverse remarks made by the Sessions Court in connection with the Thoppumpady sex racket case in Ernakulam. The Ernakulam Sessions Court made adverse remarks while dealing with the bail petitions of the accused.
No need for sureties
along with bail bond
The High Court today held that it would be unnecessary and unreasonable for criminal courts to insist on sureties for the bail bond to be executed by an accused in bailable offences unless there were special reasons to demand such sureties.
Justice R. Basant, while disposing of a criminal miscellaneous petition, observed that the court could enlarge an accused on bail on his own bond. These observations were made by the judge with a fond hope of ridding ``the unprincipled professional sureties'' who had ``contaminated'' the court premises and making user-friendly ambience in court premises.
The observations were made in the case filed by George Kutty and four other accused in a criminal case pending before the Punalur Magistrate Court. According to them, even without arresting them and producing before the court, a final report had been filed by the police before the court saying that they were absconding. They approached the High court seeking bail in the case. Disposing of the petition, the court directed the Magistrate court to consider their bail applications in the light of the observation made by the judge.
Publish list of cases
In another petition, Justice Basant also directed Magistrate and Civil Courts to publish the list of cases, to be taken up on the next day, on the previous evening and supply its copies to the Bar Associations and Advocates' Clerks Associations. It should also be published in the court notice board as well. The directions were issued in view of the difficulties being experienced by lawyers and litigants in courts. They had to wait outside court rooms without knowing whether their case would be take up or not on the day.
TTP assurance
A Division Bench of the Kerala High Court was informed by the Travancore Titanium Products (TTP), a Thiruvananthapuram-based State public sector undertaking, that the pollution control projects would be implemented within two-and-half years.
The Bench comprising the Chief Justice, J.L. Gupta, and Justice R. Basant disposed of most of the petitions complaining about the pollution being caused by the company on the basis of this undertaking.
