According to the petitioner, the Kerala Private College Teachers' Association, if the law was enacted, a general council would have to be constituted in place of the senate. The court had last week stayed all further proceedings for elections in the nine constituencies of the Kerala University Senate.
Administrator's powers
A Full Bench of the Kerala High Court today reiterated its earlier ruling that the administrators appointed to manage the affairs of the societies in place of the superseded managing committees had no power to enrol new members in the societies. The Bench comprising the Chief Justice J.L. Gupta, Justice J. B. Koshy and Justice A.K. Basheer made the ruling while setting aside the orders issued by the Administrator of the Thrissur District Cooperative Hospital Society admitting 4,600-odd members in the society. It was held by the court in the Hassan Vs Joint Registrar of Cooperative Societies case that administrators appointed under section 33 of the Kerala Cooperative Societies Act, 1969 had no power to enrol new members. This was affirmed by the Supreme Court in 2000. However, yet another Full Bench which had heard the same issue had held that the ruling would operate prospectively. The Bench held that the no other courts except the Supreme Court could hold that the decisions would be applicable prospectively.
Orders reserved
A Division Bench of the Kerala High Court today reserved its order on petition filed by the five CPI(M) convicts in the Jayakrishnan murder case seeking to transfer them from the condemned cell to ordinary prison cells. The Bench comprising Justice J. B. Koshy and Justice K. Thankappan, today heard the hearing on the petitions today. The Bench had already admitted appeals filed by the convicts against the Thalassery Sessions Court verdict awarding death sentence and life imprisonment to the CPI(M) activists.
Auction stayed
Justice K. Padmanabhan Nair has stayed the confirmation of the auction of 14 Sri Lankan vessels conducted by the Judicial First Class Magistrate Court, Kochi. The stay order came on a petition filed by the Alliance For Release of International Prisoners in India and Sri Lanka. According to it, negotiations were on between Indian and Sri Lanka Governments on the release of fishermen and boats seized by the Sri Lankan authorities. If the boats were auctioned off and sold to third parties, the Indian Government would not be able to engage the Sri Lankan Government effectively in the negotiations. So, the petitioner sought a direction to the Magistrate Court, Kochi, not to proceed with the auctioning of the vessels.
Sale of property
A Division Bench of the Kerala High Court today issued notice to the GCDA and the State Government on a writ petition challenging the GCDA's decision to sell 59.28 cents of land at Marine drive to the Excel Properties.
