The convicted youth were identified as Nawas (28) and Naji (25). The incident occurred at the family house of Nizamudeen at Kallambalam in the Varkala police station limits on November 27, 1998. The prosecution case was that the youth hacked to death their brother for barging into the family house and assaulting his wife and child in the presence of their mother. On the previous day of the crime, Nizamudeen had thrown his wife and child out of his house in a drunken fit. Nizamudeen's wife sought refuge at her mother-in-law's house where her husband's two brothers lived. On November 27, Nizamudeen barged into the family house in an inebriated condition and assaulted his wife. His younger brothers, who witnessed the violence, killed him in retaliation. There were more than 30 wounds on the body of the deceased. The accused initially told the police that Nizamudeen was hacked to death by an unidentified gang. Nizamudeen was in the business of re-possession of vehicles from loan defaulters. However, the police probe revealed that Nizamudeen was killed by his own brothers. The case was investigated by the Dy.SP (Crime Branch), B. Sasidharan, who was then the Circle Inspector (Varkala). The prosecution was conducted by Additional Public Prosecutor, Ambalathara. M. Nazimudeen, Kuttiyani Sudhir and M. Muhasin.
