Justice M. Chockalingam of the Madras High Court today admitted the appeal filed by a CB-CID DSP, and ordered notice to the former Minister. On April 4 this year, the judicial magistrate, Dharmapuri, acquitted Mr. Mullaivendan, and nine others from charges of assaulting and threatening the HR&CE Assistant Commissioner, Anbumani. The prosecution case was that the official reportedly failed to defer the auction of 29 acres of temple land at Ootamalai near Hogenakkal, at the behest of Mr. Mullaivendan. The official was reportedly summoned on February 19, 2001 to a guesthouse where the Minister was staying. But Mr. Anbumani came out of the room alleging that the Minister along with his men had beaten him up. He was hospitalised. The Dharmapuri town police registered a case. Subsequently, the DMK Government, which was in power then, ordered for a CB-CID enquiry. Based on an initial report submitted by the CB-CID, the then Chief Minister, M. Karunanidhi, ordered Mr. Mullaivendan to step down. After the trial, the judicial magistrate acquitted all the 10 accused, stating that the prosecution failed to prove beyond doubt the charges framed against them.
