Eisai said the action was in response to applications by the two firms to the U.S. Food and Drug Administration (FDA) to make a generic equivalent of Eisai's ulcer drug Aciphex. It said its U.S. patent on Aciphex is valid until May 8, 2013, and Dr. Reddy's and Teva had infringed it. Aciphex, which is classified as a proton pump inhibitor (PPI), had sales of 117 billion yen ($1.07 billion) globally in 2002-03, of which 88 per cent was in the U.S.
