Setting aside the FIR registered by the Connaught Place police on the direction by a Metropolitan Magistrate (MM) on a complaint by another MM against Jagdish Thukral, Justice J.D. Kapoor said: "In view of the nature of allegations levelled by both the parties against each other coupled with pendency of a civil suit in respect of the premises in question, the impugned order of the MM directing registration of an FIR by way forwarding the complaint of the MM, Praveen Kumar, under Section 156 (3) of the Cr.P.C. by an order dated 2.1.2002 is set aside.'' Mr. Justice Kapoor directed the MM who had ordered lodging of the FIR to take up both the complaints together in accordance with the provisions of the law governing complaint cases. In his petition, Mr. Thukral had alleged that Praveen Kumar along with other persons had tried to forcibly evict him from the premises which he was occupying as a tenant since 1986, though a suit was pending in a lower court regarding the matter.
