A three-judge Bench, comprising the Chief Justice V.N. Khare, Justice Ashok Bhan and Justice A.R. Lakshmanan, will hear the appeal, which sought quashing of the interim order passed on a batch of writ petitions challenging the October 26 ordinance, vesting the entire IMFL vending operation with the Tamil Nadu State Marketing Corporation. The High Court said that only 879 licensees 284 who had remitted the privilege amount before July 31, 2002, and 595 who had remitted the sum by September 30 could conduct retail vending from November 29 onwards. The court made it clear that retail vending shops, which were in operation as on November 28 and were run by these 879 persons, could continue the business. As for the rest of the areas, the Government was at liberty to vend IMFL itself or through the TASMAC or cooperative societies. This order was subject to the final order on the petitions, the High Court said.
