New non-bailable warrant against Yasin Malik

By Shujaat Bukhari

SRINAGAR DEC. 9. A special POTA court today issued a fresh non-bailable warrant (NBW) against the Jammu and Kashmir Liberation Front chairman, Mohammad Yasin Malik, and fixed December 18 as the next date of hearing. It also issued warrants against Amanullah Khan, Muzaffarabad-based leader of another faction of the JKLF.

The presiding officer of the POTA court in Jammu, P.N. Razdan, rejected the plea of Mr. Malik's counsel that he was out of State and be exempted from personal appearance. The officer, instead, issued a fresh NBW against him to secure his presence in court.

Mr. Malik who returned from New Delhi today told The Hindu that he had gone there to attend the marriage of a friend's daughter and had intimated the court in advance. "I am not running away and will present myself on the next date of hearing,'' he said.

The warrants have been issued under Section 512 of the CPC in the case under 3/4 TADA. "We have not received any orders from the court as of now. Let us see when the orders come," said Syed Javed Mujtaba Gillani, SSP, Srinagar.

Mr. Malik, along with another JKLF leader, Mohammad Salim, is facing trial for allegedly killing IAF personnel in 1990. The court also issued general warrants against Amanullah Khan, head of the breakaway group of JKLF in Muzaffarabad in Pakistan-occupied Kashmir. Mr. Khan was at that time chairman of the JKLF of both parts of Kashmir.
