The First Bench, comprising the Chief Justice B. Subhashan Reddy and Justice K. Gnanaprakasam, ordered the notice on the petition filed by A. Rajini of the Madurai-based Southern Districts Women Federation. The petitioner, not disputing the fact that spreading public awareness of AIDS control was the need of the hour, said, ``we are worried about the way of illogical, unscientific and vulgar propaganda pointing towards women alone.'' Stating that propaganda should be coined in decent and dignified words, it said the impugned advertisement strategy created an impression as if only women were AIDS carriers. Ms. Rajini said the advertisement, by an organ of the State, indirectly recognised and encouraged prostitution and depicted members of the working class in poor light. She faulted the police for having failed to initiate criminal action against people behind the propaganda, and wanted the respondent-agencies and officials from displaying or publishing the advertisement in the present format.
