Nedumaran gets bail in POTA case

CHENNAI DEC. 18. The Madras High Court today granted bail to four Prevention of Terrorism Act (POTA) detenus, including the Tamilar Desiyar Iyakkam leader, P. Nedumaran, who have been incarcerated for over 17 months now. Relying on the latest Supreme Court pronouncements, clarifying the applicability of the provisions governing bail and Section 21 of the POTA, a Division Bench comprising Justice V.S. Sirpurkar and Justice M. Thanikachalam said other than the charge of `objectionable speeches' and lectures, the prosecution had not recovered any explosive substance or established any nexus between the accused and some terrorist activities.

On the prosecution averment that the accused had faced many other cases since 1992, the Bench pointed out that none of them was arrested in connection with those cases, and assailed the claim that they were still under investigation. More importantly, the accused had been in jail for more than one year, so their cases could be considered to their advantage. The appellants - Mr. Nedumaran, Subha. Veerapandian, Pavannan and Thayappan - were, however, directed not to address the media or participate in any meeting during the pendency of trial. The bail plea of two others - Shahul Hameed and Paranthaman — were dismissed as withdrawn.
