On the prosecution averment that the accused had faced many other cases since 1992, the Bench pointed out that none of them was arrested in connection with those cases, and assailed the claim that they were still under investigation. More importantly, the accused had been in jail for more than one year, so their cases could be considered to their advantage. The appellants - Mr. Nedumaran, Subha. Veerapandian, Pavannan and Thayappan - were, however, directed not to address the media or participate in any meeting during the pendency of trial. The bail plea of two others - Shahul Hameed and Paranthaman were dismissed as withdrawn.
