High Court stays trial in Tsundur case

HYDERABAD, JAN. 9. M. Narayana Reddy, judge of the High Court, on Friday stayed the trial in the Tsundur case, pertaining to the killing of persons belonging to Scheduled Castes in 1991. The trail is to begin on January 21.

The judge passed these orders in a petition filed by M. Seetharami Reddy complaining that the decision of the special judge to try the case at Tsundur village is against the principles of criminal jurisprudence.

In March 1991, some houses belonging to the SC community were burnt and some people were killed at Tsundur, a rich, fertile village near Tenali in Guntur district. The Government promised that a special court will try the criminal case at Tsundur.

When the special judge declared his intention to start the trial at Tsundur the accused moved the High Court in 1994-95, which directed the trial court to reconsider the matter.

The special judge declared that the trial would be held in Guntur. The present petition has been filed challenging the recent order of the special judge to start the trial at Tsundur village. The petitioner said that the earlier order to have the trial at Guntur was final and the present incumbent cannot take a contra decision.

The petitioner said that the witnesses who are also from the village and the SC community have not chosen to come to court till this day in spite of the summons issued by the court.
