Eligible colleges denied NOC: court

KOCHI, JAN. 19. The Kerala High Court today observed that records revealed that the colleges which were found to have facilities had been denied no-objection certificates (NOC) for starting self-financing B.Ed. colleges and those found to have less facilities were granted NOCs.

Justice C.N. Ramachandran Nair also directed K. Mohandas, Principal Secretary, Higher Education, to file a detailed affidavit justifying the Government decision in declining permission for colleges with facilities, overlooking the specific directive contained in the High Court's earlier judgment.

The court observed that it was seen from the gradings awarded by the Expert Committee based on facilities available with the applicant institutions and from the list of colleges which had been granted NOCs that many colleges which had been given high marks were declined NOCs.

The court also directed that if there was any report prepared by A. Asha Thomas, Director of Collegiate Education on the relative merits of the applicants for B.Ed colleges, it be produced before the court.

When the contempt petition filed by the National Training College, Thiruvananthapuram, and others came up, the court said that the applicants who had been denied NOCs had asserted before the court that Ms Asha Thomas had prepared a report regarding the relative merit of the applicants. The court also observed that contempt proceedings would be initiated against those responsible if the colleges with less facilities were granted NOCs.

The court had also directed the State Government to grant NOCs to 75 colleges, depending on the relative merits of each applicants.

The court also directed the petitioners in another case challenging the sanction of 96 B.Ed colleges to file separate statements in a week listing the institutions against which inquiry should be ordered by a court-appointed commission.

All the cases have been posted for further hearing on January 27.
