NEW DELHI, FEB. 7 .The Central Administrative Tribunal (CAT) has asked the Transport Commissioner of the Delhi Government to consider a request for promotion by a Motor Vehicle Inspector (MVI) of the Transport Department. A Division Bench of the CAT comprising Justice V.S. Aggarwal and Justice S.A. Singh directed the Departmental Promotion Committee (DPC) to hold a review meeting to consider the request for promotion by K.K. Sharma. The Bench said that the meeting should be held within three months of the receipt of a copy of the order. It further said that the request by the petitioner should be considered in accordance with the rules and the regulations of the Department. The petitioner had moved the Tribunal when the Department failed to promote him to the next post of Motor Licensing Officer (MLO) though several officers junior to him had already been given promotion. The promotion of the petitioner had been held back due to an on-going departmental inquiry against him for breach of discipline. However, the inquiry officer concerned had exonerated him, yet he was not promoted, counsel for petitioner, Surat Singh assisted by Mamta Rani submitted. The CCS Rules of the Union Government says that "in case a Government servant is completely exonerated, the due date of his promotion will be determined with reference to the position assigned to him in the findings kept in the sealed cover/covers, and with reference to the date of promotion of his next junior on the basis of such position. The Government servant may be promoted, if necessary, by reverting the junior most officiating person,'' Dr. Singh submitted. The stand taken by the Department in its counter affidavit that the petitioner was not considered for promotion because disciplinary proceedings were pending against the office was not tenable, Dr. Singh Submitted. He further said that the Department had also admitted in the affidavit that due to an inadvertent error on its part, the name of the petitioner was not placed before the Department Promotion Committee, and also the mandatory procedure of sealed cover was not adopted by it.
