The Government have filed an appeal in the Madras High Court against the order of Mr. Justice Balakrishna Aiyar, directing the winding up of the Madras Electric Tramway Company Ltd. Mr. J. B. Beardsell, who held a power of attorney from the Directorate of the Company, filed a petition in the High Court for permission to wind up the Company on the ground that the Company was unable to pay its debts, and also that it ceased to carry on business. It was opposed by the State Government on the ground that the petition was not maintainable, and that there must be a special resolution by the Company for its winding up. His Lordship allowed the petition and ordered the winding up of the Company, stating that, when the affairs of the Company had come to such a pass that it was unable to pay its debts and to carry on business, the only rational thing to do was to wind up its affairs. Against this order of His Lordship, the appeal has been filed by the Government.
