Gujarat files appeal in Best Bakery case
By Our Legal Correspondent
NEW DELHI,
FEB. 21.
The Gujarat Government filed an appeal in the Supreme Court on Friday challenging a High Court order acquitting all the 21 accused in the Best Bakery case in which 12 persons were burnt alive by a mob.
The Special Leave Petition (SLP) is directed against a judgment of the High Court of December 26, upholding the order of a Vadodara fast track court acquitting all the accused. The High Court had also dismissed the Government's application seeking permission to bring on record evidence in the form of affidavits filed by key witness, Zaheera Sheikh, and three others, in the Supreme Court as part of an SLP filed by the Mumbai-based non-government organisation, Citizen's for Justice and Peace.
On June 27, the Vadodara court had acquitted the accused charged with burning to death 12 persons in the Best Bakery during the post-Godhra communal riots on March 1, 2002. The State Government had challenged the trial court's order on September 29, 2003 after the Supreme Court pulled up the State Government.
