Notice to TNEB on filling vacancies of engineers

CHENNAI, FEB. 27. A bid by the Tamil Nadu Electricity Board (TNEB) to fill up Assistant Engineer vacancies only through departmental promotion, without considering claims of the eligible engineering candidates, has been stayed by the Madras High Court.

The First Bench, comprising the Chief Justice, B. Subhashan Reddy, and Justice S. Sardar Zackria Hussain, granted an interim injunction on an appeal preferred by one R. Sivakumar, an engineering graduate who had completed apprenticeship with the TNEB. The judges also ordered notice to the Board.

Mr. Sivakumar contended that the Service Regulations of the Board provided for appointment of fresh candidates as well as eligible service candidates to the post of Assistant Engineers. Till 1986, the ratio of external candidates and those from the department was 3:1. It was later revised to 1:1.

While this was so, to fill up a large number of existing vacancies, the Chief Engineer (Personnel) of the TNEB wrote to all Chief Engineers and Superintending Engineers to send a list of employees of the Board for appointment as Assistant Engineers.

"The Board has not taken any steps for recruiting fresh candidates from outside as required under a relevant rule made in January 1986. As the order stands valid till date, the Board cannot ignore it and proceed in an illegal manner and consider internal candidates alone."
