Explain non-production of Chennai lawyer in court, Delhi police told

NEW DELHI, FEB. 28. A Delhi court has asked the Delhi police to explain non-production of a Chennai-based lawyer who allegedly misled the Supreme Court on the date of birth of its former Chief Justice and at present Chairman of the National Human Rights Commission (NHRC), Justice A.S. Anand.

The Chief Metropolitan Magistrate (CMM), Reena Singh Nag, asked the Deputy Commissioner of Police (DCP) of the Special Cell of the city police, Ashok Chand, to explain non-compliance of non-bailable arrest warrants (NBWs) against R. Karuppan by March 1.

The court issued several NBWs against the lawyer. The first warrants was issued by the then CMM, K.S. Pal, on August 29, 2003. However, the lawyer has since been evading appearance before the court.

The lawyer is wanted for allegedly providing wrong information on the age of Justice Anand in his writ petition seeking determination of his (Justice Anand) date of birth.

The CMM took up the matter on a complaint lodged by the Registrar-General of the Supreme Court when the latter had asked its Registry to initiate prosecution proceedings against the lawyer petitioner under Section 193 (giving or fabricating false evidence in a judicial proceeding) of the Indian Penal Code.

The apex court had taken the allegation levelled by the lawyer petitioner seriously as Mr. Karuppan moved the court despite knowing the act that the date of birth of Justice Anand had already been ascertained by the President in May 1991.
