Election of three doctors to RGUHS Syndicate upheld

BANGALORE, MARCH 6. The High Court on Friday set aside the order of the Chancellor of the Rajiv Gandhi University of Health Sciences (RGUHS) and upheld the election of three doctors to the Syndicate of the university.

The petitioners, C.N. Ashwatnarayana of Bangalore, V.I. Hukkeri, principal of KLE Society's College of Pharmacy, Hubli, and B.C. Bhagawan, Associate Professor of Surgery, KIMS, had challenged the Chancellor's order to hold fresh elections to the Syndicate.

They were elected from the Senate to the Syndicate on July 5, 2003. Dr. Veerabhadrappa, Professor, MR Medical College, Gulbarga, had challenged their election. He said the vote of R.D. Desai, doctor, was invalid as on the day of election he was not holding the post of principal. The Chancellor had set aside the election of the petitioners and ordered fresh elections. While setting aside the Chancellor's order, the Judge, H. Rangavittalachar, observed that "the RGUHS Act of 1994 is silent on the manner of filing an election petition, based on which an election can be set aside.'' Therefore, Dr. Desai's vote could not be deemed to be invalid.

Petitions rejected

The High Court Judge, Chandrashekaraiah, rejected the writ petitions challenging the acquisition of land by the Karnataka Industrial Area Development Board (KIADB) at Nagawara and Rachenahalli in Bangalore north.

The petitioners, N. Murari, Radhakrishna Rao, and others, said their land had been acquired by KIADB for setting up an information technology (IT) park. It was to be developed by Manyatha Promoters Private Ltd., a private undertaking. They said KIADB could not acquire land for private parties. The court observed that the petitioners had illegally converted their agricultural land into residential sites.

Plea for symbol

The High Court Judge, H.L. Dattu, on Friday posted to Tuesday the hearing of a petition filed by the Kannada Nadu party seeking the court's direction to the Election Commission to allot a common symbol to its candidates to contest the coming elections.

The petitioner, Ratnapal Shetty, said the party had registered with the Election Commission on September 15, 2003.
