Hartal: court can issue directives to Government

KOCHI, MARCH 11 . A Full Bench of the Kerala High Court today orally observed that if the State Government was unable to "cope with" the situation arising out of the call for hartals or strikes, the court could issue a directive to the State Government to requisition sufficient number of para-military forces in the State during hartals or strike days to ensure normality in the State.

The Bench comprising the Acting Chief Justice, N.K. Sodhi, Justice J.B. Koshy and Justice A.K. Basheer made it clear that it proposed to give such a directive as they were "quite satisfied" that directives by a Full Bench and also the Supreme Court in the bandh case had no effect on the Government. The court could not allow public properties to be damaged.

Directive to Government

Justice C.N. Ramachandran Nair has directed the State Government to consider bringing all law colleges in the State under one university and to submit a report in this regard within three weeks. The judge passed the order on a writ petition filed by Rejitha and other Ernakulam Law College students seeking to ensure that the semester examinations for the five-year LLB course were conducted on time.

Bail granted

Justice G. Sasidharan today granted anticipatory bail to seven Railway Reservation Clerks in cases relating to unauthorised sale of reservation tickets.

The judge ordered that the clerks working in the Ernakulam North Station, Cochin Harbour Terminus and Cherthala Railway Station be released on bail on their executing a bond for Rs. 20,000 each with two solvent sureties in the event of their arrest.

Law College polls stayed

Justice C.N. Ramachandran Nair today stayed the conduct of college union elections at the Thiruvanananthapuram Government Law College, scheduled for March 12.

The stay was passed on a writ petition filed by Jaleel Mohammed, a student. According to him, the college had been closed following the outbreak of chicken pox in the college and most of the students could not participate in the election.
