Cop remanded for killing during anti-Mandal stir

NEW DELHI, MARCH 12. A Delhi Court today sent Police Inspector D P Singh in judicial remand after he appeared in a case relating to killing of 15-year-old Aditya Narayan on September 25, 1990 during the height of nation-wide anti-Mandal agitation.

After hearing the arguments on his bail application, Additional Sessions Judge J M Malik reserved the order for March 15 and sent the accused in judicial remand till March 20.

Mr Malik also fixed March 20 for hearing arguments on charges against the accused.

Yesterday, Metropolitan Magistrate Dig Vinay Singh had committed the case to a Sessions Court for trial observing that ``Killing of a person by a police officer can not be claimed to have done under the colour of duty or authority nor in excess thereof.'' Mr Singh had observed that there was sufficient evidence to pursue criminal charges against then Police Sub Inspector Singh for killing Aditya.

Mr Singh in his order said, ``From the perusal of the chargesheet and the material on record, I am satisfied that there is sufficient material to proceed under section 302 (murder) or at least under section 304 of the IPC against the accused for firing at Aditya.''

Mr K N Sharma, father of victim Aditya, had lodged a complaint with the police on September 25, 1990 that his son was ``deliberately shot in the forehead by accused D P Singh'' even though he did not take part in the agitation. According to the complaint, Aditya, a minor, was walking on the footpath in Sarojini Nagar area in Central Delhi when the bullet hit him on his head. Aditya died on October 14, 1990 in a hospital.

Quoting the inquiry report, the Judge said, ``It is not in dispute in the present case that the bullet which was recovered from the body of Aditya was indeed allegedly fired from the pistol of Singh.'' ``In the complaint Sharma had clearly alleged that accused Singh deliberately shot at Aditya,'' he said. - UNI
