Bar hotels told to pay bank guarantee

KOCHI, APRIL 6. The Kerala High Court today made it clear that if bar hotel owners and the Kerala Bar Hotels Association did not pay the bank guarantee for enhanced licence fee within one month, the Excise authorities would be free to close down the bar hotels.

Justice K. Balakrishnan Nair made the observation on a petition filed by the Government seeking clarification on the court's interim order yesterday. The court had earlier stayed the Government order on slab system for licence fee.

Plea rejected

Justice G. Sasidharan today declined a plea of the Transport Commissioner, K. P. Somarajan, seeking a direction to the CBI to transfer the investigation into the Munna murder case to one of the CBI units outside the State.

The Judge, however, directed the CBI Director to consider his representations seeking to ensure a fair and impartial investigation into the case. The petitioner said the CBI was trying to falsely implicate him in the case at the instance of its counsel. The petitioner said the CBI counsel in the High Court had harboured enmity toward him.

Lottery case

The High Court Bench comprising Justice Cyriac Joseph and Justice K. Padmanabhan Nair today reserved the judgment on an appeal filed against a single judge's order upholding the restrictions imposed on the sale of lotteries including online of other States. The judgment would be pronounced on April 22. When the appeal came up before the court, the Advocate General, M. Ratna Singh, sought vacation of the stay on the Single Judge's order. The appeal was filed by the Meghalaya Government and other lottery agents.

PSC appointment

Justice K. Balakrishanan Nair today declared unconstitutional the Public Service Commission (PSC) decision to advise candidates for the posts of clerks in the Motor Transport Workers Welfare Fund Board from the rank list prepared for clerks in the Travancore Titanium Company. The court held that the PSC had no power to advise candidates from another rank list for appointments of clerks in TTC as per the PSC procedure rules. The verdict came on a writ petition filed by Deepa of Sultan Bathery challenging the PSC's decision.
