Supreme Court stays order on Independent

NEW DELHI,
APRIL 10.
The Supreme Court has stayed an order passed by a Division Bench of the Andhra Pradesh High Court directing the Returning Officer of Nagarkurnoor constituency in Mahabubnagar district to treat an Independent as a Telangana Rashtra Samiti (TRS) candidate and allot `car' symbol for the Lok Sabha polls.
A Bench, comprising Justice N. Santosh Hegde and Justice B.N. Agrawal, granted the stay on a special leave petition filed by Dr. Manda Jaganath of the Telugu Desam Party (TDP) challenging the impugned order dated April 5. The Bench issued notice to the respondent, K.S. Rathnam, on whose writ petition the High Court had passed the order.
Mr. Rathnam filed his nomination paper for the Nagarkurnool (SC) constituency as a candidate set up by the TRS. Since his nomination papers were found to be defective, the Returning Officer passed orders treating him as an Independent.
On a writ petition from Mr. Rathnam, the High Court directed that he be treated as TRS candidate and allotted the car symbol. Aggrieved by the order, Dr. Manda filed the SLP. Dr. Manda contended that the High Court had erred in entertaining the writ petition from Mr. Rathnam.
