NEW DELHI, APRIL 12. The Delhi High Court today issued notices to the Union Government, the Delhi Development Authority (DDA) and the Station House Officer (SHO) of the Najafgarh police station on a petition seeking directions to the Authority to pay a compensation of more than Rs. 3.5 lakhs to a petitioner for allegedly causing extensive damages to her residential premises mistakenly while pulling down illegal shops in the neighbourhood of her house. The petitioner, Kusum Lata, a resident of RZ-5, Hira Park Extension, Najafgarh, in West Delhi, submitted through her counsel, Sunil Kumar, that her house caved in under the weight of the debris of the unauthorised shops during their demolition on January 13.Mr. Kumar said that his client and her family members were lucky enough not to get hurt in the incident, however, she lost her household articles as they had to flee for their lives. The petitioner said that the official of the Authority, A.K. Bhalla, and the Assistant Commissioner of Police (ACP), Rajesh Dev, present on the spot at the time of the demolition had admitted the mistake and assured her that she would be duly compensated. The petitioner later gave representations to the DDA and the Union Labour Minister, Sahib Singh Verma but nothing was done to right the wrong done to her in the past three months since the incident. She further said that the compensation she had made claim for was based on an estimated valuation of the damages to the house by a government valuer.She urged the court to direct the Authority to rebuild the house as well as provide necessary household articles to her. Petitioner's counsel submitted that the High Court was well within its powers to issue directions to the Authority, as the later is an agency of the State as defined under Article 12 of the Constitution.
