KOCHI, APRIL 23 . A Division Bench of the Kerala High Court today made it clear that the pendency of cases relating to the selection of self-financing B.Ed. college would not stand in the way of the Government completing the selection process and forwarding the list of selected institutions for starting self-financing B.Ed. colleges to the National Council for Teacher Education (NCTE). The Bench comprising Justice Cyriac Joseph and Justice K. Padmanabhan Nair made the observation when appeals filed against a single judge's verdict directing the Government to conduct afresh selection of institutions. The judges allowed the NCTE to process the applications of the institutions forwarded to it by the Government in accordance with the rules and regulations. The Bench added that any decision taken on the matter by the Government and the NCTE would be subject to the final decision of the court on the appeals. The court directed that the institutions concerned, which could secure recognition from the NCTE, should not start the courses without the permission of the court. The court said the cases were adjourned to May 21 since there was no sufficient time to hear them today and also the process of selection undertaken by the Government on the basis of the High Court order had not been completed.
Marad case
The hearing on the appeal filed by the Director General of Police and other police officers against a single judge's order directing the police to furnish intelligence reports relating to the Marad incidents before the Judicial Commission inquiring into the Marad massacre had been adjourned to May 21. The Bench had earlier directed the Commission not to disclose any portion of the intelligence report submitted by the intelligence wing of the State police and the answers given by the intelligence agency to certain questions put forward by the Commission to any persons including counsel for parties before the Commission.
Bail plea adjourned
Justice K. Thankappan today adjourned to May 27 the hearing on the petition filed by the jailed PDP chief, Abdul Nasir Maudany, seeking bail in criminal cases registered against him by the Sasthamkotta police. The criminal cases were registered under the provisions of Explosives Act, Arms Act, Unlawful Activities (Prevention) Act in 1992.
Petition against Minister
A Bench comprising Justice K. Thankappan and Justice Pius C. Kuriakose posted to April 27 a quo warranto writ petition t seeking to remove K. Sankaranarayan, Finance Minister, from the post for making a speech in Thiruvananthapuram. The petitioner, Yehiya of Kollam, pointed out that while inaugurating a function organised in connection with the World Consumer Protection Day on March 14 in Thiruvananthapuram, he had said that if any attempt were made to punish those who indulged in adulteration of food articles, he would not be able to remain as Minister. According to the petitioner, the speech had showed that the Minister was incompetent to take action against those who indulged in adulteration of food articles. In fact, his speech amounted to pleading helplessness though he was bound to enforce the laws relating to the prevention of food adulteration. Thus, he had violated the oath of office, according to the petitioner.
Thookam case
A writ petition filed by Maheswaran Bhattathirippad, general secretary, the Kerala Urayama Devaswom Board, seeking police protection for A.K. Chandrasekharan Nair, a newly appointed Sreekariyam (manager) of the Elavoor Temple, to take charge was adjourned to April 27. The present manger, Janardhanan, had been placed under suspension by the Board following his action in ordering demolition of the compound wall of the temple for conducting Thookkam. Mr. Nair had been appointed in the place of Mr. Janardhanan. However, the committee members did not allow him to take charge.
