NEW DELHI, APRIL 26. The Supreme Court today dispensed with the personal appearance of the Tamil Nadu Speaker, K. Kalimuthu, in the trial court till July 19 in the Robin Mayne case. A three-judge Bench comprising Chief Justice V.N. Khare, Justice S.B. Sinha and Justice S.H. Kapadia said the April 13 order "that the petitioner shall not be required to appear before the court for two weeks" was extended till July 19, when the case would come up for further hearing. It passed the order after hearing K.K. Venugopal, senior counsel for the petitioner. The charge against Mr. Kalimuthu in the case, filed by the Central Bureau of Investigation, is that during his tenure as Agriculture Minister in 1983 he deposited huge funds of the Tamil Nadu State Agricultural Marketing Board with nationalised banks. It was alleged that he asked the officers of the banks to advance vehicle loans to the tune of Rs. 56 lakhs to the main accused, Robin Mayne, and others. Mr. Kalimuthu filed a petition in the trial court contending that in the absence of sanction from the government, it could not take cognisance of the case. The trial court upheld his contention but on appeal by the CBI, the Madras High Court on March 31 reversed it and directed Mr. Kalimuthu to appear in the court on April 16 for facing trial. The present special leave petition was directed against this judgment. Mr. Kalimuthu prayed for a direction to set it aside and for an interim stay of its operation. On April 13, the apex court, by an interim order, dispensed with his appearance for two weeks.
