KOCHI, APRIL 27. The Kerala High Court today directed the jailed PDP chief, Abdul Nasir Maudany, to move his bail petition in cases registered against him for making provocative speeches and also under various provisions of the Arms Act and Unlawful Activities Prevention Act before the Ernakulam Additional Chief Judicial Magistrate's Court within one week. Justice K. Thankappan ordered that the bail petition be considered on the date of its submission without considering the arrest warrant pending against him. Issuing the directions, the court observed that the petitioner had been in jail for the last six years without conviction and it was inhuman. The cases against him were registered at the Sasthamkotta police station in 1992. The petitioner said that he was arrested in the Coimbatore Bomb Blast case in 1998 and had been in jail since then. He said that the trial in the Coimbatore bomb blast case had reached the final stage. Besides, he had sought bail in the case before the Madras High Court. He was optimistic that he would get bail in the case. He could not wait till the pronouncement of an order on his bail petition by the Madras High Court because if the High Court granted him bail, he would still be in jail in connection with the case registered by the Sasthamkotta police. Besides, he had been in jail for the last six years. When the petition came up, the Director General of Prosecutions submitted that he had been in jail and even if he was granted bail, he could not come out of the prison. Besides, he was the chief of the banned outfit, Islamic Seva Sangh (ISS). Besides, the cases pending against him had been registered under section 153A of the Indian Penal Code (IPC) for creating enmity between different groups on the grounds of religion.
