CHENNAI, MAY 1. The Madras High Court has directed the Election Commission to consider and dispose of, by May 3, a Bharatiya Janata Party letter seeking withdrawal of its order asking States to mask the picture of Prime Minister A.B. Vajpayee on hoardings put up along the Golden Quadrilateral (NH-7A). The First Bench, comprising the Chief Justice B. Subhashan Reddy and Justice M. Thanikachalam, making clear that the subject matter fell within the EC's domain said the BJP's representation to the Commission was made on March 25. Any cause of action, requiring judicial intervention, would arise only if the EC passed an order, the judge said. The petitioner, B. Rabu Manohar, contended that the hoardings announcing the project had been erected long before the election process was set in motion. However, following a communication from the EC on March 16, 2004, the Chief Electoral Officer in the State ensured that all hoardings with Mr. Vajpayee's picture were covered with white cloth. J. Madanagopal Rao, senior Central Government standing counsel, faulting the direction and consequent action, submitted that under the guise of the code of conduct a remarkable achievement should not be blocked from the public view.
