Refund of deposit ordered

VISAKHAPATNAM: The Visakhapatnam District Consumer Forum has directed a company to refund the deposit with 12 per cent interest along with Rs.1,000 towards costs.

A resident of Trinathapuram of Malkapuram area in the city, A.K. Singh, induced by an advertisement made by Videocon International Limited, purchased a colour television set as the latter issued a security deposit receipt under money-back scheme. When he was not paid the maturity value after completion of five years, the consumer filed a complaint (Consumer Dispute No: 149/2004) in the Forum for repayment of the maturity value of Rs.8,990 with 24 per cent interest per annum along with costs of the complaint, against the Videocon International Limited in Mumbai and against Wilington and Associated in Hyderabad. The opposite parties received notice but did not choose to appear and contest the case and, therefore, the Forum heard the case and passed orders on merits on the material available on record.

In their recent verdict, the Forum president, P. Jagannadham Naidu, and its Members, P.S.N. Rao and D. Suseela, noted that the opposite parties had failed to repay the maturity amount of Rs.8,990, even after repeated requests of the consumer upon which the latter approached the Forum. "The complainant is a consumer. The service rendered by the opposite parties is for a consideration and, therefore, the dispute is a consumer dispute. By adopting unfair trade practice, the opposite parties collected deposits. Failure to repay the amount on date of maturity amounts to deficiency in service. Hence the complainant is entitled to reliefs,'' they held. In the result, the opposite parties were directed to refund Rs.8,990 with 12 per cent interest per annum till the date of realisation to the consumer. The Forum further awarded Rs.1,000 towards costs of the complaint.
