BANGALORE, JUNE 1. The Karnataka High Court on Tuesday pulled up the headmistress of a school in Gulbarga for impersonation. The petitioner, Rukhiya Begum, headmistress of Al-Ameen Urdu School, said that on November 12, 2003, the Joint Director of Public Instruction (JDPI) ordered that grant-in-aid should not be released to the institution. She urged the court to quash the order and restore the grant-in-aid. She said the JDPI had issued a show cause notice to her five months before the November 12 order. She said that she had lost the notice while travelling by a bus and hence, she could not reply to it. The notice accused the headmistress and a head constable, Mohammad Rajasab, of cheating in the departmental promotional examination of 2002 conducted by the State Government. It said the headmistress had appeared for five of the nine papers on behalf of the head constable. The examination was only for government servants and there was no reason for her to appear for it. The authorities conducted an inquiry when they found that the handwriting in nine papers did not tally. In his order, Justice Gururajan said: "A headmistress holding a responsible post has chosen to be a party in an examination to help a policeman. Such tendencies are to be arrested or else they would spread like a disease, affecting the very purpose of examinations." Dismissing the petition, he said that he agreed with the order passed by the JDPI. "If the law permits, initiate criminal proceedings against the petitioner," he said.
Hearing
Two death sentences awarded by the Sessions Court of Mysore came up before the High Court for hearing. In the first case, Shivaprakash, alias Shivu of T. Narsipura in Mysore district, kidnapped K.H. Praveen, a student of Gyana Ganga School in Mysore, on August 17, 1996. Shivu went to the school at 9 a.m. and asked Praveen to accompany him. He had written to Praveen's father asking him to pay a ransom of Rs. 1.25 lakh. The body of Praveen was found on August 21 in the Krishna Raja Sagar (KRS) Reservoir near Mysore. Shivu was arrested and the Mysore Sessions Court sentenced him to death on April 19, 2004. In another case, Hotte Subramani of Hinkal, Mysore, was sentenced to death on April 28, 2004 for murdering Nagendra of Balahalli village in Mysore district. Hotte Subramani had a grouse against Nagendra. In 2002, Hotte Subramani along with Kumar (now dead) and Suresh took Nagendra to a remote place and chopped off Nagendra's legs. After severing his head, they threw the body into a well.
Notice
A Division Bench comprising the Chief Justice, N.K. Jain, and Justice Mohan Shantana Goudar ordered issue of notice to the Bangalore Development Authority (BDA), the Bangalore Mahanagara Palike (BMP), and others on a public interest litigation by Kota Subramanyam of Secunderabad in Andhra Pradesh. The petitioner had urged the court to direct the respondents to demolish some buildings at Gerehalli village in Bangalore North taluk and Hoskerehalli village in Bangalore South taluk. He had also appealed to the court to direct the authorities not to give electricity connections to "unauthorised" constructions in these villages. He challenged the constitutionality and conduct of the BDA and the BMP in allowing such constructions to come up on the land that had been acquired by the then City Improvement Trust Board (CITB) and a notification issued on May 9, 1968 for forming Banashankari 3rd Stage Layout. The final notification was issued on October 28, 1971. Since then, the land was with the BDA. He said Vishwabharati House Building Cooperative Society Ltd. and a respondent, Krishna Bhat, had formed the Girinagar 4th Phase Layout. The BDA, he said, did not take any action to form a layout after the October 1971 notification. He contended that the BDA should demolish the "unauthorised" buildings. The Division Bench ordered issue of notice and adjourned the hearing.
Promotions stayed
The High Court on Monday stayed the promotion of an employee of the Karnataka Legislative Assembly Secretariat as the Under Secretary. The petitioners, A. Rangaswamy and N. Gopalakrisha Rao, said that they had been working as section officers in the Secretariat. However, on May 18, another employee, Murthy, was promoted as the Under Secretary. The petitioners said that they were senior to Mr. Murthy in service and were more qualified than him. They urged the court to stay the promotion. Justice N. Kumar ordered issue of notice to the respondents and stayed the promotion. In another case, Mr. Justice N. Kumar stayed the promotion of four employees of the Secretariat as deputy secretaries. In his petition, N. Gururaja said that on May 18, Kempaiah, T. Jayathirtha, S. Basavaraju, and Shivarudrappa were promoted by the Assembly Secretary, N. Rajanna, as deputy secretaries. Mr. Gururaja said that he was working as an in-charge deputy secretary and his name was not considered for the post. He said that his omission was intentional. He urged the court to stay the promotion of the respondents. Mr. Justice N. Kumar ordered issue of notice and stayed the promotion.
