NEW DELHI, JUNE 28. The Supreme Court today issued a notice to the Bihar Government on a petition filed by the Chief Minister, Rabri Devi, challenging the disproportionate assets case filed by the CBI against her and her husband, Laloo Prasad Yadav, without proper sanction for their prosecution. A vacation Bench comprising Justice K. G. Balakrishnan and Justice P. Venkatarama Reddi issued a notice through the CBI after hearing senior counsel, Ram Jethmalani. Appearing for both Mr. Yadav and Mrs. Rabri Devi, Mr. Jethmalani said that the agency had not obtained the requisite sanction against the Chief Minister for her prosecution. He said that four years ago, Mr. Yadav challenged his prosecution in the assets case on the question of sanction and the High Court admitted the petition finding that there was a substantial question of law to be decided. But no further orders were passed on this petition.
