CHENNAI, JUNE 29. A special court here could not frame charges against the former Agriculture Minister, Ku.Pa. Krishnan, as three of the accused filed petitions seeking discharge from the ``disproportionate wealth'' case filed against Mr. Krishnan. The prosecution took notice of the applications and the special judge posted the matter for filing of counter by July 9. Mr. Krishnan submitted that he was a Minister in the AIADMK Government between June 24, 1991 and May 12, 1996. In the charge sheet, the property, which was shown, as his assets prior to the check period were not correct and it was much more. The value was purposely reduced in the statement submitted along with the charge sheet. Also, a reduced agricultural income was furnished in the charge sheet. Similarly, the assets shown at the end of the check period were also not correct. The property of others were shown as his. As per the Benami Transaction Act, property of others could not be his. The Income-Tax authorities also said the property did not belong to him. There was no evidence either through documents or witnesses statements to show that the other nine accused (one since deceased) had abetted the offence. He submitted that his father`s property was not considered by the police. The prosecution case against Mr.Krishnan is that he had accumulated wealth to the tune of Rs.3.72 crores, which was ``disproportionate to known sources of his income''. While Mr. Krishnan had been charged under Section 13 (2) and 13 (1) (e) of the Prevention of Corruption Act (PCA), the other accused had been charged under Section 109 (abetment) of the IPC, 13 (2) and 13 (1) (e) of the PCA. During the last hearing, the judge posted the case for today for framing of charges. All the accused were present.
