KOLKATA, JULY 1. Five city policemen were sentenced today to life imprisonment by a trial court which convicted them yesterday on charges of outraging the modesty of a woman and killing an off-duty traffic sergeant, Bapi Sen, for trying to stop them from harassing her on December 31, 2002. "I restrain from awarding a capital punishment for the heinous crime only in [the] light of the their age and the fact they belong to a disciplined force," said Basudev Majumdar, the judge of the city Sessions Court. The constables, Sridam Bauri, Pijush Goswami, Sheikh Mujibur Rahman, Madhusudhan Chakraborty and Shekhar Bhusan Mitra, belonged to the Reserve Police Force. Awarded life imprisonment under Section 302 of the Indian Penal Code, they were also fined Rs. 10,000 each in default of which they would undergo six months rigorous imprisonment. Under Section 354 (assault on woman with intent to outrage her modesty), they would have to undergo six months' rigorous imprisonment. Defence lawyer Tapas Mukhopadhyay said he would challenge the verdict before the Kolkata High Court within a week on the basis of "crucial evidence." In the packed courtroom, the judge asked the constables whether they had anything to say in their defence to which they pleaded innocence. "In the first complaint to the police, Bapi Sen's friends alleged that two persons had assaulted Sen while in the second one they put the figure to five," Mr. Mukhopadhyay said. According to him, the prosecution should identify the two named in the first report failing which all the five should get the benefit of doubt. He claimed that Sen was "under the influence of liquor that night as per a medical report."
