HYDERABAD, JULY 17. A Division Bench of the High Court on Friday declared that the admissions to professional courses based on the GO Ms.33, conferring reservation to Muslims, will be subject to further orders on a writ petition challenging the GO. The Bench, comprising the Chief Justice, Devinder Gupta, and Justice Rohini, passed these orders while dealing with the writ petition filed by T. Muralidhara Rao, a resident of Hyderabad. . It may be recalled that a GO was issued conferring 5 per cent reservation in favour of Muslims for seats in educational institutions and public employment. The petitioner argued that the procedure contemplated under the Supreme Court judgment and Act made for the purpose were not followed in the issue. The counsel for the petitioner, K. Ramakrishna Reddy, contended that the GO was arbitrary and the reservation for a religious denomination was unconstitutionaland drew the attention of the court to several judgments in this regard. D. Sudershan Reddy, Advocate General, wondered how such petition was filed and termed the petitioner a `busy body'. He said that if a student had approached the court, it could have considered the prayer for interim stay on operation of the GO. The Bench did not appreciate the insistence for stay of the GO in a public interest petition and posted the matter to Wednesday.
