Kalimuthu's appearance dispensed with until further orders

NEW DELHI, JULY 19. The Supreme Court today dispensed with the personal appearance of the Tamil Nadu Speaker, K. Kalimuthu, in the trial court until further orders in the `Robin Mayne case'. (The trial court fixed his appearance for tomorrow).

A Bench comprising Justice Santosh N. Hegde and Justice S.B. Sinha extended the order passed on April 13 and 26 "that the petitioner shall not be required to appear before the trial court". Initially the stay was granted for two weeks on April 13, and on April 26 it was extended till July 19. The Bench passed the order after hearing petitioner's senior counsel, P.P. Rao.

The Central Bureau of Investigation's case against Mr. Kalimuthu is that during his tenure as Agriculture Minister in 1983, he deposited large funds of the Tamil Nadu State Agricultural Marketing Board with several nationalised banks.

It was alleged that Mr. Kalimuthu had asked the officers of the banks to advance vehicle loans of Rs. 56 lakhs to the main accused, Robin Mayne and others.

Mr. Kalimuthu filed a petition in the trial court contending that in the absence of sanction from the Government, it could not take cognisance of the case. The trial court upheld his contention and on appeal by the CBI, the High Court, by an order dated March 31, reversed it and directed Mr. Kalimuthu to appear in court. The SLP was directed against this order.
