Lower court order on maintenance quashed

LUCKNOW, AUG. 3. The Lucknow Bench of the Allahabad High Court today quashed a lower court order rejecting a plea for maintenance by a Muslim woman, Sadiqunnissa, after being divorced and directed the court to ascertain whether the separation was in accordance with the `Shariat' (Islamic jurisprudence).

Justice I. M. Quddusi, allowing a revision filed by Ms. Sadiqunnissa challenging the Sitapur court order, directed it to record its findings after hearing both the parties and getting evidence in support of their statements whether the `Talaq' had been effected in accordance with the `Shariat'.

The Court said that the Talaq law as ordained by the Holy Quran was — it must be pronounced in three different sittings, it must be for a reasonable cause and must be preceded by an attempt of reconciliation between the husband and the wife by two arbiters, one chosen by the wife's family and the other by the husband and if their attempts fail, then the talaq might be effected and has to be proved by the husband before the Court.
