Telegram treated as habeas corpus petition

MADURAI, AUG. 3. The Chief Justice of the Madras High Court, B. Subhashan Reddy, today directed the Madurai Bench to treat the telegram of a petitioner as a habeas corpus petition and issue suitable directions to the Virudhunagar police.

The petitioner, Alagirisamy of Sivakasi in Virudhunagar district, had sent a telegram to the Chief Justice stating that his daughter, Jayalakshmi, who was taken for questioning by the police on July 2 along with four other family members had not returned home. He had received telephone calls that his daughter was murdered.

A bench comprising Judges, M. Chockalingam and M. Karpagavinayagam, directed the Sivakasi police to produce Jayalakshmi in court on August 9.

Directive to college

A private engineering college near Sivakasi in Virudhunagar district was directed to keep a seat in abeyance till the disposal of a petition filed by a candidate.

Pandiarajan of V. Meenakshipuram in Sivakasi had filed a writ petition praying the Madurai Bench of the Madras High Court to direct the private engineering to allot him a seat. He contended that he had paid the fee for a seat under the management quota on May 19.

However, the college authorities later informed him that his fee would be returned since the seats (under management quota) had been surrendered to Anna University as per the latest guidelines. Since the last date for applying for admission through the single window system was already over, the petitioner sought allocation of seat in the college.

The Judge, F.M. Ibrahim Khalifullah, directed the private engineering college to keep a seat in abeyance and ordered that notices be issued to the college authorities and the Registrar of Anna University, seeking an explanation.

Demolition notice

The Madurai Bench today authorised the Sankarapuram panchayat near Sakkottai in Sivaganga district to issue demolition notice to an automobile service station at Karaikudi.

The contention of the Sankarapuram panchayat president was that the service station was constructed without approval and its pollutants were getting mixed with the Sambai Oorani, which was a vital source of drinking water for Karaikudi.

The owner of the service station claimed that his was not the only establishment on the locality and a Tamil Nadu State Transport Corporation depot and restaurants were also located in close vicinity.

Disposing of the petition, Mr. Ibrahim Khalifullah, asked the Sankarapuram panchayat to issue demolition notice to the service station and to initiate action as per law.

Bail plea dismissed

The bail petition of N. Suresh Babu, Inspector of K. Pudur police station in Madurai, who was arrested in connection with a double murder case and placed under suspension, was dismissed today. The prosecution argued that the case was under investigation and the accused, if let on bail, would influence the witnesses in his favour.

The Judge, D. Murugesan, dismissed the bail petition.

Two acquitted

Two persons sentenced to life imprisonment were acquitted today.

The duo, Thennarasu and Alagar of Bethaniapuram in Madurai, were accused of murdering an autorickshaw driver on October 24, 1996. The Karimedu police had arrested them within 24 hours of the murder.

A sessions court in Madurai sentenced them to undergo life imprisonment.

When the appeal petition came up for hearing, the petitioners' counsel pointed to certain violations of the `Police Standing Orders' by the investigators in the process of collecting fingerprints of the accused in prison.

Mr. Karpagavinayagam, ordered the acquittal of Thennarasu and Suresh.
