NEW DELHI, AUG. 9. The Bharatiya Janata Party general secretary and spokesperson, Arun Jaitley, today demanded an answer from the Government on whether the CBI had decided to appeal against the Delhi High Court judgment in the Bofors case holding that the Prevention of Corruption Act could not apply to the case. Addressing a press conference here today, Mr. Jaitley then went on to answer the question himself pointing out that there was a "limitation" of appeal in the case till July and that date was now past. "But why did the CBI not appeal in the case? The Government should clarify," he said. However, when asked why the previous Government led by Atal Bihari Vajpayee did not get the CBI to appeal in the Supreme Court against the judgment, Mr. Jaitley said he did not know why it was not done, perhaps it was because elections were round the corner. In fact, copies of the Bofors judgment of the High Court were with the CBI by mid-March this year, a whole month before the elections. At that time the CBI knew that it had only 90 days within which it should file an appeal if it wished to. The press asked questions on why the Vajpayee Government had not filed an appeal against the court judgment absolving former Deputy Prime Minister, L.K. Advani, of all charges in the Babri Masjid demolition case. Mr. Jaitley said: "There were some old criminal cases going on against some who have influence in this (Manmohan Singh) Government. To ensure that no influence is brought to bear on the course of law, some important issues arise. In a Delhi court in a disproportionate assets case a verdict has come in favour of Shibu Soren (former Union Minister). Has the CBI filed an appeal against this? If not, why not? Was the Government's view taken by the CBI?''
