10-year RI for raping minor

COIMBATORE, AUG. 10. The Judge of the "Magalir Neethimandram," S. Kalavathy, today convicted and sentenced Vasudevan (27) to undergo ten years of rigorous imprisonment on charges of abducting and raping a 12-year-old girl.

According to police, the accused abducted the minor girl from her house in Poosaripalayam in Selvapuram police limits, took her to the mulberry garden inside the Tamil Nadu Agricultural University and committed rape on November 14, 2002.

The police arrested Vasudevan and registered cases under section 366 (abducting and inducing a girl) and 376 (i) of IPC for rape.

The judge observed, "rape is a crime not only against a woman and it is a crime against society. It pushes her into deep emotional crisis. The honour of a woman and dignity cannot be violated, against her right to lead a honourable and peaceful life."

She observed that rape is an evil that need to be eliminated. "When the prosecution evidences are trustworthy, reliable, cogent, natural and un-impeachable acquitting the accused would encourage the criminals in committing violence against women."

She awarded ten years RI for the offence under sec 366 of IPC and a fine of Rs. 5,000.

In default to pay the fine, the accused would have to undergo one-year of simple imprisonment. She also convicted and sentenced the accused to undergo ten years' rigorous imprisonment for the offence committed under section 376 (i) of IPC besides a fine of Rs. 10,000. Failing to pay the fine, the accused would have to undergo one more year of simple imprisonment, she added.

Compensation

Out of the fine amount of Rs 15,000, Rs 10,000 has been awarded as compensation to the girl under provisions of section 357 of Criminal Procedure Code (CrPC).

The sentences would run concurrently and the imprisonment already undergone during the trial period is being set off under section 428 of CrPC.
