'Issue notice to vendors before termination of licence'

CHENNAI, AUG. 14. The Madras High Court has directed the State Government to terminate the licences of stamp vendors only after issuing notice and giving them 15 days to submit explanation.

Justice R. Balasubramanian passed an interim order to this effect on a writ petition filed by K.V. Gowri of Villivakkam here.

In her petition, Ms. Gowri contended that her licence was terminated on August 3, pursuant to a show-cause notice issued by the District Registrar (Central), Alwarpet on June 18.

However, her counsel Narmadha Sampath said the termination order did not contain any of the allegations mentioned in the show-cause notice, and the petitioner was not put on notice. "The allegations enumerated in the show-cause notice were not the subject matter of the termination order," the counsel said.

She said though Rule 25 (iv) of the Tamil Nadu Stamp Rules provided for an appeal to the Revenue Divisional Officer against the termination order, it could be filed only against the orders of the Tahsildar or Deputy Tahsildar having independent charge. On this ground, Ms. Gowri's appeal could be declared not maintainable as the impugned order had been passed by the District Registrar. The petitioner prayed for quashing the impugned order, besides an interim stay on the operation of the order, issued on August 3.

Admitting the plea, Mr. Balasubramanian ordered notices to the District Registrar, Alwarpet and the Tahsildar (Purasawalkam-Perambur).
