Preventive detention order struck down

HYDERABAD,
AUG. 19.
A Division Bench of the State High Court comprising Justice Bilal Nazki and Justice S. Ananda Reddy struck down the order of preventive detention passed by the district Collector, Guntur, against Jojireddy.
The Bench was allowing the writ petition filed challenging the detention of Jojireddy, who was put under preventive detention for his alleged activity in supplying spurious seeds.
It was brought to the notice of the Bench that the order was passed under previsions of the Andhra Pradesh Preventive Detention Act 1970, which has been superseded by the National Securities Act of 1980s.
The Bench expressed dismay at the order of the preventive detention passed by senior officers under the provisions of the Act that has been superseded.
The Bench awarded costs for the detection, which was not as per the law.
