HUBLI, AUG. 23. The Madhya Pradesh Chief Minister, Uma Bharti's revision petition seeking withdrawal of the criminal case against her pending in a Hubli court in connection with the Idgah disturbances of 1994 was dismissed today by J. D'Cunha, Additional District and Sessions Judge. The Judge rejected the petition on the ground that it was time-barred and that sufficient grounds had not been adduced for condoning the delay in filing the petition. Fresh appeal V.G. Patil, counsel for Ms. Bharti, told presspersons later that the High Court of Karnataka would be moved on Tuesday seeking quashing of this order as also the one passed by the Judicial Magistrate, First Class, two years ago. A petition moved by the Karnataka Government on June 21, 2004 that the case could be dismissed as "not pressed" and subsequent application filed on August 18, 2004 by the prosecution seeking withdrawal of its revision petition were also dismissed. However, nothing was said about the non-bailable warrant to be served by a Karnataka police team on Ms. Bharti in Bhopal. The only plea made by Dorairaju, also counsel for Ms. Bharti, was that the contents of today's order should be communicated to the Karnataka police, to which the Additional District and Sessions Judge agreed. On the possibility of the Karnataka police team now in Bhopal serving the arrest warrant on Ms. Bharti, Mr. Patil said there was no bar on the order being served. But Ms. Bharti would have to be produced before a magistrate who could give her bail and also time for her to appear before the Hubli Court.
