According to the police, Gursewak, who was lodged in Nabha jail in Punjab, was charged with sedition and carrying explosives in a case registered at Punjabi Bagh police station in West Delhi in 1998. The case had come up for hearing in the court of Additional Sessions Judge, Yogesh Khanna, at Tis Hazari. Gursewak was supposed to appear between August 23 and 26. Punjab police brought Gursewak to the Capital on Monday evening and lodged him in Subzi Mandi lock-up. Around 10 p.m., Gursewak complained of chest pain. The Punjab police team, comprising a head constable and three constables, decided to take him to Bara Hindu Rao Hospital in their vehicle. On the way, their vehicle developed a snag and they decided to take Gursewak to the hospital on foot. After walking a few yards, Gursewak told the team that he needed to relieve himself. He went over to one side and then fled taking advantage of the darkness.
